I have expired Iqama. How can I travel back to Pakistan?

If your company / Kafeel is in red category of Nitaqat system, then you may travel back, however, if it is in green then you will have to file a case in labour court. The procedure for final exit is as follows;

You have to submit a form (copy attached) in the Consulate General along with copy of Iqama and Passport. The Consulate General will forward these documents to the Labour Office. The labour office will scrutinize the application as per local laws. If cleared, your case will be forwarded to the Immigration office by the labour office. The immigration office will again scrutinize your application, and after necessary clearance, will endorse final exit visa to you.

I got Final Exit from my sponsor but could not go to Pakistan. How can I travel to Pakistan?

After getting a Final Exit from the sponsor, a person has to leave the kingdom within two months otherwise, the person is considered illegal and if arrested may serve sentence along with deportation.

In order to be able to travel to Pakistan without being detained, the person will have to approach his sponsor who can get him a fresh final exit after payment of penalties.

Those who were on Umrah Visa but could not travel back due to any reason and have become illegal. Is there any scheme for them?

Those who came to the Kingdom on Umrah Visa and have not been able to return and their visas have expired; can return home without any penalties. The Consulate General would process their cases and forward to immigration department for final exit.

After going to Pakistan on Exit Re-Entry; can I come back on a new visa?

Any employee who goes on Exit Re-Entry and does not come back to the Kingdom within time of Exit Re-Entry, the employee gets banned for three years from entry into the Kingdom on any type of work visa.

The workers who are Haroob ‘Abscoders from work and get deported through Jail/Deportation Centre are banned from entry into the kingdom for how many years?

Those workers who get deported from the Kingdom are usually banned for the period from five to ten years depending upon the nature of the case and as determined by the Jawazat (Immigration Office) from time to time.

I have been working with my company for last fifteen months. The company is not allowing me to go on Final Exit. Can the Consulate General help in getting Final Exit?

As per local laws, both the Employee and the Employer have to follow the Service Agreement. If your Agreement with the company is for two years, it is not appropriate to leave after fifteen (15) months.

You are required to complete the period as mentioned in the Agreement and give two months’ notice to the sponsor informing him of your intention to go on Final Exit.  If then the sponsor is not allowing Final Exit, then you may file a complaint/case for Final Exit in Labour Office. The legal department of the Consulate General would provide necessary guidance in the matter.

My sponsor has declared me as Haroob ‘Absconder from work’. How can I get my Haroob Status cancelled?

It is advised to settle the matter with your sponsor and try to get it canceled. The sponsor has the option to cancel Huroob status within twenty days without penalty. If he does not cancel, then the worker is required to submit the case in Labour Office. The case/complaint can be submitted online. At the Labour Office, you will be required to present evidence that the Haroob Declared by the sponsor is illegal. In case of any further guidance, the Welfare Wing of the Consulate General can be contacted. 

My sponsor makes me work harder and pays less. I told him to pay more or allow me to go on Final Exit. However, he does not agree on either Final Exit or increasing my salary. What should I do?

As per the Service Agreement, you do not have the right to demand more than the agreed amount. The salary is fixed. If you are being paid less than the agreed salary, only then you can file a complaint/case in concerned Labour Office.

I was caught by the Saudi Police while working elsewhere. It's been three years now since I came back to Pakistan. After how much time can I go back to Saudi Arabia?

Those who are deported from Saudi Arabia through deportation, they are usually not allowed to enter Saudi Arabia for a specific period, which is determined by Saudi government.

What is the process of local burial inside the Kingdom of Saudi Arabia?

Ans.  In order to carry out local burial of any deceased inside the Kingdom, No Objection Certificate (NOC) may be obtained from Consulate General of Pakistan, Jeddah for which the following documents are required:

  1. Iqama copy of the deceased
  2. Passport copy of the deceased
  3. Tableegh e Wafat (Death Report) of the Hospital
  4. Affidavit from the legal heirs for local heirs by duly nominating an individual as attorney to identify and receive dead body from the hospital.
  5. Arabic translation of the affidavit (being done by the mission to facilitate the deceased’s family)
  6. Attorney Name, Iqama Number and Contact Number

The issued NOC be attested from the Ministry of Foreign Affairs of Kingdom by paying the attestation fee of 30 SAR. The attested NOC along with above documents and hospital Tableegh e Wafat may be provided to the Baldiya Department for local burial. There is no other fee involved in local burial.

What is the procedure of transporting dead body to Pakistan?

Ans.   In order to transport the dead body to Pakistan, No Objection Certificate (NOC) for Transportation may be obtained from Consulate General of Pakistan, Jeddah for which the following documents are required:

  1. Iqama copy of the deceased
  2. Passport copy of the deceased
  3. Tableegh e Wafat (Death Report) of the Hospital
  4. Affidavit from the legal heirs for local heirs by duly nominating an individual as attorney to identify and receive dead body from the hospital.
  5. Arabic translation of the affidavit (being done by the mission to facilitate the deceased’s family)
  6. Attorney name, Iqama Number and Contact Number

Steps involved in Transportation are as under:

  1. Translate the Affidavit into Arabic and get it attested from the Consulate General (welfare) Office.
  2. Obtain NOC for transportation from Consulate General (Welfare Wing)
  3. Complete the attestation of issued NOC and Arabic Translation of the Affidavit from the Ministry of Foreign Affairs, Kingdom of Saudi Arabia
  4. Get booking from Cargo Office (Private companies operating in the Kingdom)
  5. Submit documents (Attested NOC, Attested Affidavit Arabic, Deceased Passport Copy, Deceased Iqama Copy, Tableegh e Wafat/Death Certificate of Hospital and Cargo Bill) to Governor Office/Ammara or Police Station. In case of Road Accidental death, submit the mentioned documents in the Traffic Police.
  6. The concerned office where the documents are submitted will issue two letters. One in the name of Hospital where the dead body is lying stating therein that the dead body may be handed over to the attorney holder/Wakeel e Sharaye as nominated in the affidavit by the lega heirs. The second letter will be issued in the name of AL-Ahwal Almadani (Civil Affairs Department) for the generation of the Death Certificate of the deceased. These two letters may be collected by the attorney holder for submission in the hospital and in the Civil Affairs Department.
  7. With the above original documents, approach the Civil Affairs Department for generation of the Death Certificate.
  8. Submit all above documents to the Hospital and deposit an amount of 5,000 SAR as Government Fee in the designated bank account and obtain original receipt (yellow color).
  9. Submit all documents mentioned above to the Cargo Company/Office for booking of Flight for the transportation of the dead body to Pakistan.
  10. Submit one copy of the above documents to the Jawazaat (Immigration Department) and process exit of the dead body.
  11. Submit the exit copy to the Cargo Company/office.
  12. After getting the Flight Booking, approach the concerned Hospital where dead body is lying well before 24 hours and request for transfer of the dead body from the Hospital to Tib-e-Sharayee for embalming as per the procedure of Kingdom of Saudi Arabia by providing the proof and receipt of 5,000 SAR Government Fee paid.

Please note that in case there are any movable properties standing on the name of the deceased, it has to be transferred to some other individual as per the Kingdom Laws and Procedure. The Immigration office will not apply exit unless there is no outstanding fee or liability standing in the name of the deceased.  It is further apprised that in case there is some Haq-e-Khas or unpaid liability in the name of the deceased, the same may be cleared before approaching the immigration office.

It is further noted that while moving dead body for embalming from the Hospital to Tib-e- Sharayee, the same shall be done till Wednesday of every week before 3:00 PM. No dead bodies are received on Thursday and Friday as per SOP.

What is the total cost involved in local burial inside the Kingdom?

Ans.   The local burial is free of cost and there is no fee involved. The dead body will be buried in the nearby graveyard where the dead body is lying as per the Kingdom law.

What is the total cost involved in transportation of dead body to Pakistan?

Ans.   In order to transport the dead body to Pakistan, Government Fee of embalming amounting to 5,000 SAR be paid in the designated banks. Furthermore, as per the Kingdom law and procedure, the human remains can be transported through designated Cargo Companies operating in the Kingdom in their specially designed air-conditioned carriers, for which the cargo companies’ charges ranges from 2,125 to 3,000 SAR depending on the distance from the Jeddah Airport.

What is the fee of Cargo Companies in the Western Region of the Kingdom of Saudi Arabia?

Ans.   The fee of the Cargo Companies operating in the Western Region of the Kingdom including (Jeddah, Makkah, Madina, taif, Jizan, Najran, Abha, Al-Baha) is as under. The legal heirs are free to approach any of the Cargo Companies and get their dead body transported to Pakistan.

How the End of Service Benefits of a deceased who died in the Kingdom of Saudi Arabia be claimed?

Ans.   In order to claim the end of service benefits of the deceased, a Power of Attorney (Both English and Arabic) in the name of Consulate General of Pakistan, Jeddah (or private attorney) may be execute all the legal heirs residing in Pakistan and to authorize the mission or private attorney to approach the Company/Sponsor for the end of service benefits of the deceased. The Power of Attorney must be attested from MOFA Islamabad (or any regional office in Pakistan) and Embassy of Saudi Arabia, Islamabad. The Power of Attorney shall be accompanied with Succession Certificate (both English and Arabic) and Guardianship Certificate (both English and Arabic) in case of minor kids.

What is the process of claiming blood money (Diyat) in case of death in a road accident in the Kingdom of Saudi Arabia?

Ans.   In case of road accidental death, as per the Shariah Law of the Kingdom of Saudi Arabia, blood money (Diyat) is paid to the legal heirs. In order to claim the blood money (Diyat) the following documents are required:

  1. Power of Attorney in the name of Consulate General of Pakistan, Jeddah (or private attorney) from all the legal heirs
  2. Succession Certificate obtained from Courts (in small cities in Pakistan) and Nadra (in big cities in Pakistan)
  3. Guardianship Certificate in case of minors

The above documents be attested from the MOFA Islamabad (or any regional office in Pakistan) and Embassy of Saudi Arabia, Islamabad and sent through OPF Islamabad. Please note that blood money proceedings are carried out in Shariah Court(s) [ General Court and Implementation Court] and is a subjudice matter, and the blood money is received only after the decision of the Court(s).

What is the process of claiming Social Insurance (GOSI) of a deceased in the Kingdom of Saudi Arabia?

Ans.   Insurance claims basically pertains to Companies and as per the Saudi Social Insurance Law issued under Royal Decree No. M/22 dated 6/9/1389H for lump sum compensation in case of work accidental death. The following documents are required to process Social Insurance Case:

  • Form 31/Annuities attached to be COMPLETED by you and certified by NOTARY PUBLIC.
  • Original or certified supporting official document listing the heirs names, ages and relationship to the deceased insured person.
  • Determination of heirs from the court.
  • Certified copy of the marriage contract of the widow(s) of the late insured person. 
  • Certified copy of the birth certificate or I.D of the widow(s), sons, brothers, father, mother, and unemployed unmarried daughters and sisters of the deceased insured person who were supported by the deceased at the time of his death.
  • School certificates of the dependent sons and brothers who are still studying after age 21.
  • If the father of the deceased is still alive and was supported by his late son and his age is (60) or less than that and disabled, he should send a medical report duly signed by two physicians of a government or university hospital showing brief description and diagnosis of his case, indicating/assessing his age and stating the physical/medical causes which have made him unable to work and the date of his disability must occur before the death of his son. The said medical report should be certified by official local authority (NOTARY PUBLIC) in your country. However, the father is not required to submit a medical report if his age is 60 years or over but birth certificate required.

Also, the following instructions should be observed.

  1. All the documents should be sent to the E-mail: compensation_ri@gosi.gov.sa                    
  2. The inured number should be quoted in all your documents with the General Organization for Social Insurance (GOSI).
  3. The information provided in Form 31/Annuities should be complete and correct, and you will in respect thereof, bear all the responsibilities and penalties provided for in the Social Insurance Law and Regulations.
  4. All the required documents must be translated into English (if issued in a different language) and certified by your official local authority (Notary Public).

What is the procedure of attestation of legal documents from Ministry of Foreign Affairs inside the Kingdom of Saudi Arabia?

Ans.   The attestation of any legal document including NOC for local burial or Transportation of dead body to Pakistan, Power of Attorney (Arabic), Succession Certificate (Arabic) or Guardianship Certificate (Arabic) or General Pardon Affidavit (Arabic) is being done by the Ministry of Foreign Affairs, Kingdom of Saudi Arabia by paying a nominal fee of 30 SAR per document.

What is the procedure of attestation of legal documents from Ministry of Justice inside the Kingdom of Saudi Arabia?

Ans.   The attestation of any legal document including NOC for local burial or Transportation of dead body to Pakistan, Power of Attorney (Arabic), Succession Certificate (Arabic) or Guardianship Certificate (Arabic) or General Pardon Affidavit (Arabic) is being done by the Ministry of Justice, Kingdom of Saudi Arabia without any cost. It may be noted that legal documents in Diyat cases are required to be attested from Ministry of Justice as per the Kingdom law.
